Le damos la bienvenida a Kbinets Mexico. Los términos "nosotros" y "nuestro(s)/nuestra(s)" hacen referencia a Kbinets Mexico. Kbinets Mexico opera esta tienda y sitio web, incluida toda la información, el contenido, las funciones, las herramientas, los productos y los servicios para brindarle a usted, el cliente, una experiencia de compra seleccionada (los "Servicios"). Kbinets Mexico cuenta con tecnología de Shopify que nos permite brindarle los Servicios.

Su pedido no se aceptará hasta que Kbinets Mexico confirme la aceptación. Debemos recibir y procesar su pago para la aceptación de su pedido. Revise minuciosamente su pedido antes del envío, ya que es posible que Kbinets Mexico no pueda dar lugar a solicitudes de cancelación una vez aceptado un pedido. En caso de que no aceptemos, modifiquemos de forma alguna ni cancelemos un pedido, intentaremos notificarlo mediante el correo electrónico, la dirección de facturación o el número de teléfono que se proporcione al realizar el pedido.
Sus compras están sujetas a devoluciones o cambio únicamente conforme a nuestra Política de reembolso [ENLACE].
Usted declara y garantiza que sus compras son únicamente para uso personal o doméstico y no para reventa o exportación con fines comerciales.

SECCIÓN 4: PRECIOS Y FACTURACIÓN
Los precios, los descuentos y las promociones están sujetos a cambios sin previo aviso. El precio cobrado por un producto o servicio será el que tenga efecto en el momento en que se haga el pedido y se establecerá en el correo electrónico de confirmación de pedido que reciba. A menos que de forma expresa se determine algo diferente, los precios publicados no incluyen cargos por impuestos, envío, gestión de pedidos, trámites aduaneros ni importación.
Los precios publicados en nuestras tiendas online pueden diferir de los que se ofrezcan en tiendas físicas, online o de otro tipo administradas por terceros. De tanto en tanto, es posible que ofrezcamos promociones por los Servicios que pueden afectar los precios y se rigen por términos y condiciones distintos a estos Términos. Si existe un conflicto entre los términos de una promoción y estos Términos, prevalecerán los términos de la promoción.
Para todas las compras realizadas en nuestras tiendas, usted acepta brindar información actual, completa y precisa sobre compras, pagos y cuentas. Usted acepta actualizar con prontitud información de su cuenta y otros aspectos, como su dirección de correo electrónico y los números y las fechas de vencimiento de sus tarjetas de crédito, para que podamos completar sus transacciones y contactarlo según sea necesario.
Usted declara y garantiza que (i) la información de la tarjeta de crédito que brindó es verdadera, correcta y completa; que (ii) cuenta con la debida autorización para utilizar dicha tarjeta de crédito para la compra; que (iii) que la empresa de su tarjeta de crédito cubrirá los cargos por usted asumidos; y que (iv) usted pagará los cargos asumidos a los precios publicados, incluidos los cargos de envío, gestión de pedidos e impuestos vigentes, si existen.

SECCIÓN 5. ENVÍO Y ENTREGA
No nos responsabilizamos por las demoras en envíos y entregas. Todos los tiempos de entrega están sujetos únicamente a estimaciones y no se garantizan. No nos responsabilizamos por demoras ocasionadas por empresas de transporte, procesamiento aduanero ni eventos que no estén bajo nuestro control. Una vez que entregamos los productos a la empresa de transportes, la titularidad y el riesgo pasan a estar en manos de usted.

SECCIÓN 6: PROPIEDAD INTELECTUAL
Nuestros Servicios, incluidos, a título no limitativo, las marcas registradas, las marcas, el texto, las muestras, las imágenes, los gráficos, las reseñas de productos, el video y el audio, y el diseño, la selección y la disposición de estos, son propiedad de Kbinets Mexico, sus afiliados o licenciantes y están protegidos por legislaciones de Estados Unidos y extranjeras sobre derechos de autor y propiedad intelectual de otra clase.
Estos términos le permiten utilizar los Servicios únicamente para fines personales y no comerciales. No debe reproducir, distribuir, modificar, copiar en trabajos derivados, exhibir públicamente, incluir en demostraciones públicas, volver a publicar, descargar, almacenar ni transmitir el material incluido en los Servicios sin previo consentimiento por escrito de nuestra parte. A menos que se establezca de manera expresa en el presente documento, ninguna sección de estos Términos otorga ni se deberá interpretar como indicio de otorgamiento de una licencia ni de ningún otro derecho a usted respecto de patentes, marcas registradas, derechos de autor ni ninguna otra forma de propiedad intelectual de Kbinets Mexico, Shopify o terceros. El uso no autorizado de los Servicios puede constituir una violación de leyes federales y estatales sobre propiedad intelectual. Kbinets Mexico se reserva todos los derechos no otorgados de forma expresa en el presente documento.
Los nombres, logos, nombres de productos y servicios, diseños y eslóganes de Kbinets Mexico son marcas registradas de Kbinets Mexico, sus afiliados o sus licenciantes. No debe utilizar dichas marcas registradas sin previo consentimiento por escrito de Kbinets Mexico. El nombre, el logo, los nombres de productos y servicios, los diseños y los eslóganes de Shopify son marcas registradas de Shopify. Todos los demás nombres, logos, nombres de productos y servicios, diseños y eslóganes de los Servicios son marcas registradas de sus respectivos propietarios.

SECCIÓN 7: HERRAMIENTAS OPCIONALES
Es posible que, como parte de los Servicios, se le brinde acceso a herramientas de cliente ofrecidas por terceros sobre las que no aplicamos supervisión, control ni colaboración.
Usted reconoce y acepta que brindamos acceso a dichas herramientas "tal como están" y "según estén disponibles" sin garantías, representaciones ni condiciones de ningún tipo, y sin respaldo. No asumiremos responsabilidades que surjan del uso que usted haga de las herramientas opcionales de terceros.
A su entera discreción, usted asumirá el riesgo por el uso que haga de las herramientas opcionales de terceros que se ofrezcan a través del sitio, y deberá asegurarse de conocer y aprobar los términos bajo los cuales los terceros proveedores ofrecen las herramientas.
Es posible que, en el futuro, también ofrezcamos nuevas funciones a través de los Servicios (incluido el lanzamiento de herramientas y recursos nuevos). Estas nuevas funciones también se deberán considerar como parte de los Servicios y estarán sujetas a estos Términos del servicio.

SECCIÓN 8: ENLACES DE TERCEROS
Los Servicios pueden contener materiales e hipervínculos a sitios web provistos o manejados por terceros (incluida cualquier funcionalidad incrustada de terceros). SECCIÓN 9: RELACIÓN CON SHOPIFY

Kbinets Mexico cuenta con tecnología de Shopify, que nos permite brindarle los Servicios. Sin embargo, cualquier venta y compra que efectúe en nuestra tienda se realiza directamente con Kbinets Mexico. Al utilizar los Servicios, usted reconoce y acepta que Shopify no se responsabiliza por ningún aspecto de las ventas que tienen lugar entre usted y Kbinets Mexico, lo que incluye lesiones, daños o pérdidas ocasionados por los productos y servicios adquiridos. Por el presente, exonera de manera expresa a Shopify y sus afiliados de cualquier reclamación, daño y responsabilidad que surja de sus compras y transacciones con Kbinets Mexico o se relacione con ellas.

SECCIÓN 10: POLÍTICA DE PRIVACIDAD
Toda la información personal que recopilamos a través de los Servicios está sujeta a nuestra Política de privacidad, que se puede consultar aquí [ENLACE], y determinada información personal puede estar sujeta a la Política de privacidad de Shopify, que se puede consultar aquí. Al utilizar los Servicios, usted reconoce que leyó estas políticas de privacidad.
Dado que los Servicios se alojan en Shopify, Shopify recopila y procesa información personal vinculada a su acceso a los Servicios y el uso que haga de ellos a fin de brindar y mejorar los Servicios para usted. Con el propósito de brindarle servicios, la información que usted envíe a los Servicios se transmitirá a Shopify y a los terceros que puedan encontrarse en países en los que usted no resida, y se compartirá con ellos. SECCIÓN 11: COMENTARIOS
Si usted envía, carga, publica, comunica por correo electrónico o transmite de otro modo ideas, sugerencias, comentarios, reseñas, propuestas, planes u otro contenido (en conjunto, los "Comentarios"), nos otorga una licencia perpetua, internacional, sublicenciable y libre de regalías para utilizar, reproducir, modificar, publicar, distribuir y exhibir dichos Comentarios en cualquier medio y para cualquier propósito, incluido el uso comercial. Por ejemplo, podemos hacer uso de nuestros derechos conforme a esta licencia para manejar, brindar, evaluar, optimizar, mejorar y promocionar los Servicios, y para cumplir con nuestras obligaciones y hacer valer nuestros derechos conforme a los Términos del servicio.
Usted también declara y garantiza que: (i) posee todos los derechos necesarios para todos los Comentarios; (ii) divulgó cualquier compensación o incentivo recibidos en relación con su envío de los Comentarios; y (iii) sus Comentarios cumplirán con los presentes Términos. No tenemos ni tendremos la obligación de (1) dar carácter confidencial a sus Comentarios; (2) brindar compensación por sus Comentarios; ni (3) responder a sus Comentarios.
Podemos, sin ninguna obligación de hacerlo, supervisar, editar o eliminar Comentarios que, a nuestra exclusiva discreción, determinemos que sean ilegales, ofensivos, amenazantes, calumniosos, difamatorios, pornográficos, obscenos u objetables bajo algún otro concepto, o bien que supongan una violación a la propiedad intelectual de cualquier parte o de estos Términos del servicio.
Usted acepta que sus Comentarios no violarán ningún derecho de terceros, incluidos los derechos de autor, marca registrada, privacidad, personalidad, u otros derechos personales o de propiedad. También acepta que sus Comentarios no contendrán observaciones calumniosas ni ilegales, abusivas u obscenas, ni virus informáticos u otro malware que pudiera afectar de alguna forma el funcionamiento de los Servicios o cualquier sitio web relacionado. Usted no podrá utilizar una dirección de correo electrónico falsa, simular ser otra persona ni inducir a engaño, tanto en nuestro caso como en el de terceros, respecto del origen de los Comentarios. Usted tiene la responsabilidad exclusiva por cualquier Comentario que realice y por su precisión. No nos responsabilizamos por Comentarios publicados por usted o por terceros.

SECCIÓN 12: ERRORES, IMPRECISIONES Y OMISIONES
De tanto en tanto, puede haber información acerca de los Servicios o en ellos que contenga errores tipográficos, imprecisiones u omisiones que puedan relacionarse con descripciones de productos, precios, promociones, ofertas, cargos de envío de productos, tiempos de tránsito y disponibilidad. Nos reservamos el derecho a corregir cualquier error, imprecisión u omisión y cambiar o actualizar información o cancelar pedidos ante cualquier imprecisión en la información, en cualquier momento, sin previo aviso (incluso después de que usted haya realizado su pedido).

SECCIÓN 13: USOS PROHIBIDOS
Usted podrá acceder a los Servicios y utilizarlos únicamente para fines legales. Usted no podrá acceder a los Servicios ni utilizarlos, de forma directa o indirecta: (a) para fines ilegales o malintencionados; (b) para violar normativas, leyes u ordenanzas locales internacionales, federales, provinciales o estatales; (c) para infringir o violar nuestros derechos de propiedad intelectual o los derechos de propiedad intelectual de otros; (d) para acosar, someter a abuso, insultar, perjudicar, difamar, calumniar, desacreditar o intimidar a nuestros empleados o a otra persona; (e) para transmitir información falsa o engañosa; (f) para enviar, recibir a sabiendas, cargar, descargar, utilizar o reutilizar material que no cumpla con estos Términos; (g) para transmitir o procurar el envío de "correo basura", "mensajes en cadena", "correo no deseado" o cualquier otro contenido similar; (h) para usurpar la identidad de cualquier otra persona o entidad, o intentar hacerlo; (i) para incurrir en cualquier otra conducta que restrinja o inhiba el uso o disfrute de los Servicios por parte de alguien o que, según los determinemos, pueda perjudicar a Kbinets Mexico, a Shopify o a usuarios de los Servicios, o bien exponerlos a responsabilidades.
A su vez, usted acepta no hacer lo siguiente: (a) cargar o transmitir virus o cualquier otro tipo de código malicioso que se utilice o se pueda utilizar de cualquier manera que afecte la funcionalidad o prestación de los Servicios; (b) reproducir, duplicar, copiar, vender, revender o explotar cualquier fracción de los Servicios; (c) recopilar o someter a seguimiento la información personal de otros; (d) enviar correo no deseado, practicar phishing, cometer fraudes farmacéuticos, practicar escenificación fraudulenta, cometer delitos de araña, o cometer rastreo o scraping web; ni (e) interferir o eludir las funciones de seguridad de los Servicios o cualquier sitio web relacionado, otros sitios web o Internet. Nos reservamos el derecho a suspender, desactivar o cerrar su cuenta en cualquier momento sin previo aviso si determinamos que usted violó alguna parte de los presentes Términos.

SECCIÓN 14: RESCISIÓN
Es posible que rescindamos este acuerdo o interrumpamos su acceso a los Servicios (o a cualquier parte de estos) a nuestra entera discreción en cualquier momento sin previo aviso, y podrá permanecer vigente su responsabilidad por todos los montos adeudados hasta la fecha de rescisión, inclusive.
Las siguientes secciones continuarán vigentes luego de la rescisión: Propiedad intelectual, Comentarios, Rescisión, Descargo de responsabilidad de garantías, Limitación de responsabilidad, Indemnización, Divisibilidad, Renuncia, Acuerdo completo, Cesión, Legislación vigente, Política de privacidad y cualquier otra disposición que por su naturaleza persista después de la rescisión.

SECCIÓN 15: DESCARGO DE RESPONSABILIDAD DE GARANTÍAS
La información presentada en los Servicios o a través de ellos se pone a disposición únicamente para información general. No garantizamos la precisión, la completitud ni la utilidad de esta información. Cualquier confianza que usted deposite en esta información queda bajo su cuenta y riesgo. Rechazamos toda responsabilidad que surja de la confianza depositada en dichos materiales por parte de usted o de cualquier visitante respecto de los Servicios, o bien de cualquier persona que pueda estar al tanto de su contenido.
A MENOS QUE Kbinets Mexico LO ESTABLEZCA DE MANERA EXPRESA, LOS SERVICIOS Y TODOS LOS PRODUCTOS QUE SE OFRECEN A TRAVÉS DE LOS SERVICIOS SE PROPORCIONAN "TAL COMO ESTÁN" Y "SEGÚN ESTÉN DISPONIBLES" PARA USO POR PARTE DE USTED, SIN REPRESENTACIÓN, GARANTÍAS NI CONDICIONES DE CLASE ALGUNA, INCLUIDA TODA GARANTÍA IMPLÍCITA O CONDICIÓN DE COMERCIALIZACIÓN, CALIDAD COMERCIABLE, IDONEIDAD PARA UN FIN DETERMINADO, DURABILIDAD, TÍTULO Y NO VIOLACIÓN. NO GARANTIZAMOS NI DECLARAMOS QUE USTED PODRÁ HACER USO DE LOS SERVICIOS DE MANERA ININTERRUMPIDA, OPORTUNA, SEGURA O LIBRE DE ERRORES. EN ALGUNAS JURISDICCIONES SE LIMITA O NO SE PERMITE EL DESCARGO DE RESPONSABILIDAD DE GARANTÍAS IMPLÍCITAS O DE OTRA CLASE, POR LO CUAL ES POSIBLE QUE ESTE DESCARGO DE RESPONSABILIDAD NO SE APLIQUE EN SU CASO.

SECCIÓN 16: LIMITACIÓN DE RESPONSABILIDAD
EN LA MEDIDA QUE LO PERMITA LA LEY, BAJO NINGUNA CIRCUNSTANCIA Kbinets Mexico, NUESTROS SOCIOS, DIRECTORES, EJECUTIVOS, EMPLEADOS AFILIADOS, AGENTES, CONTRATISTAS, PROVEEDORES DE SERVICIOS O LICENCIANTES NI LOS DE SHOPIFY Y SUS AFILIADOS TENDRÁN RESPONSABILIDAD POR LESIONES, PÉRDIDAS, RECLAMACIONES NI DAÑOS DIRECTOS, INDIRECTOS, FORTUITOS, PUNITIVOS, ESPECIALES O RESULTANTES DE NINGUNA CLASE, INCLUSO, A TÍTULO NO LIMITATIVO, PÉRDIDAS DE BENEFICIOS, PÉRDIDAS DE INGRESOS, PÉRDIDAS DE AHORROS, PÉRDIDAS DE DATOS, COSTOS DE REEMPLAZO O DAÑOS SIMILARES, YA SEA QUE SE BASEN EN CONTRATOS, AGRAVIOS (INCLUIDA LA NEGLIGENCIA) O RESPONSABILIDAD ESTRICTA, QUE SURJAN DEL USO, POR PARTE DE USTED, DE CUALQUIERA DE LOS SERVICIOS, NI POR NINGUNA OTRA RECLAMACIÓN RELACIONADA DE LA FORMA QUE SEA CON EL USO, POR PARTE DE USTED, DE LOS SERVICIOS O DE CUALQUIER PRODUCTO, INCLUSO, A TÍTULO NO LIMITATIVO, CUALQUIER ERROR O DAÑO DE CUALQUIER CLASE COMO RESULTADO DEL USO DE LOS SERVICIOS O DE CUALQUIER CONTENIDO (O PRODUCTO) PUBLICADO, TRANSMITIDO O PUESTO A DISPOSICIÓN A TRAVÉS DE LOS SERVICIOS, AUN CON APERCIBIMIENTO SOBRE LA POSIBILIDAD DE QUE SE PRODUZCA.

SECCIÓN 17: INDEMNIZACIÓN
Usted acepta indemnizar, defender y eximir de responsabilidad a Kbinets Mexico, Shopify y nuestros afiliados, socios, ejecutivos, directores, empleados, agentes, contratistas, licenciantes y proveedores de servicios ante cualquier pérdida, daño, responsabilidad o reclamación, incluido el costo de honorarios razonables de un abogado, pagadero a cualquier tercero como consecuencia de (1) el incumplimiento, por parte de usted, de estos Términos del servicio o de los documentos que incorporan como referencia, (2) la violación de cualquier ley o derecho de terceros, o (3) el acceso a los Servicios y su uso por parte de usted.
Lo notificaremos ante cualquier reclamación sujeta a indemnización, con la consideración de que la incapacidad de efectuar la notificación con prontitud no lo eximirá de sus obligaciones a menos que haya sufrido daños significativos. Es posible que controlemos la defensa y resolución de dicha reclamación con gastos a cuenta de usted, incluida la elección del abogado, pero no resolveremos reclamaciones que impongan obligaciones no monetarias por parte de usted sin su consentimiento (sin demora no justificada). Usted colaborará en la defensa de reclamaciones sujetas a indemnización, por ejemplo, proporcionando documentos pertinentes.

SECCIÓN 18: DIVISIBILIDAD
En caso de que se determine la ilegalidad, nulidad o inaplicabilidad de alguna disposición de los presentes Términos del servicio, dicha disposición deberá ser aplicable en la medida que lo permita la legislación vigente y la sección inaplicable se deberá considerar excluible de los presentes Términos del servicio; tal determinación no afectará la validez ni la aplicabilidad de ninguna otra disposición.

SECCIÓN 19: RENUNCIA; ACUERDO COMPLETO
El hecho de que no ejerzamos o hagamos valer algún derecho o alguna disposición de los Términos del servicio no constituirá una renuncia a tal derecho o disposición.
Los presentes Términos del servicio y las políticas o normas operativas que publicamos en este sitio o con respecto al Servicio constituyen en su totalidad el acuerdo y entendimiento entre usted y nosotros, rigen el uso del Servicio por parte de usted y prevalecen ante cualquier acuerdo, comunicación y propuesta anterior o presentes, en formato oral o escrito, entre usted y nosotros (incluida, a título no limitativo, cualquier versión anterior de los Términos del servicio).
Cualquier ambigüedad en la interpretación de los presentes Términos del servicio no se deberán interpretar en contra de los intereses de la parte que haya redactado el documento.

SECCIÓN 20: CESIÓN
Usted no podrá delegar, transferir ni ceder el presente Acuerdo ni sus derechos u obligaciones conforme a los presentes Términos sin nuestro previo consentimiento por escrito, y cualquier intento de hacerlo se considerará nulo y sin valor. Podemos transferir, ceder o delegar los presentes Términos junto con los derechos y las obligaciones que nos corresponden sin su consentimiento ni aviso para usted.

SECCIÓN 21: LEGISLACIÓN VIGENTE
Los presentes Términos del servicio y los acuerdos separados mediante los cuales le brindamos Servicios se deberán regir e interpretar en virtud de los tribunales federales y estatales o territoriales de la jurisdicción a la que pertenece Kbinets Mexico. Usted y Kbinets Mexico expresan sumisión a fuero y jurisdicción en dichos tribunales.

SECCIÓN 22: ENCABEZADOS
